Photography Terms

1. PHOTOGRAPHY SERVICES

Lucas Clemente offers photography work including portrait photography, cosplay photography and event photography.

Sessions and collaborations are discussed and arranged individually by email. The scope, date, location, duration, deliverables and any applicable fee are agreed before the work is confirmed.

2. ENQUIRIES AND CONFIRMATION

An initial email enquiry is not, by itself, a confirmed booking.

A session or assignment is considered confirmed once the essential arrangements have been agreed in writing by both parties. Any project-specific conditions take precedence over these general terms to the extent that they differ and have been expressly agreed.

3. PRICING AND PAYMENT

Any applicable fee, expenses, payment method and payment deadline will be communicated and agreed before the session or assignment is confirmed.

No additional fee or expense will be charged without prior agreement.

4. CANCELLATION AND RESCHEDULING

If either party needs to cancel or reschedule, they should inform the other as early as reasonably possible.

Any cancellation fee, non-refundable expense or alternative arrangement must be agreed in writing for the specific project before the booking is confirmed. These general terms do not create an automatic cancellation fee.

5. IMAGE SELECTION, EDITING AND DELIVERY

The number of delivered photographs, editing style, file format, delivery method and estimated delivery time depend on the nature and scope of the project and will be agreed where appropriate.

Unless otherwise agreed, the photographer selects and edits the final photographs. RAW files, unedited photographs and rejected images are not included in the delivery.

6. COPYRIGHT AND PERSONAL SHARING

The photographer retains copyright in the photographs, unless a different arrangement is expressly agreed in writing.

People appearing in delivered photographs may share them on their personal, non-commercial social media accounts, provided that the photographer is clearly credited, the original account or website is tagged or linked where possible, and the photographs are not altered. This permission does not authorise commercial use, resale or licensing.

7. PUBLICATION IN THE PHOTOGRAPHER’S PORTFOLIO

The photographer may wish to show selected photographs in a portfolio, on social media or in other promotional contexts. Whether a photograph may be published depends on the circumstances, applicable personality rights and any permission or other legal ground required.

For individual portrait sessions, publication should be discussed with the person photographed and, where appropriate, documented separately. Agreeing to a photography session does not automatically mean that every photograph may be published for promotional purposes.

For public events and conventions, publication is assessed in light of the event context, the role of the person in the image, the nature of the photograph and applicable law. A general event attendance or venue ticket should not be treated as blanket permission for every individual portrait.

8. COOPERATION AND CONDUCT

Both parties are expected to communicate respectfully and provide relevant information in a timely manner. Any specific safety, access, venue or event rules must be respected during the session or assignment.
